DWI TIPS
Don't blow. That's right! The officer will ask you to take a breathalyzer test, but you can refuse. It is true that in Texas they can suspend your license longer if you refuse the breath test, but refusing will go far in helping you win your case. Plus, if you take the breath test and blow over a .08, they will suspend your license anyways. Request a blood test instead.
Don't do ANY sobriety tests. The officer who pulls you over will be videotaping you. He will try to make you go through difficult tests that almost everyone is destined to fail. Politely refuse the tests by requesting an attorney or by saying you have a right to refuse the tests. Do this both at the scene where you are pulled over and at the police station. You can always refuse sobriety tests.
Be polite. Being polite to the officer while he is conducting his interrogation helps to bring a jury on your side. Don't get the jury angry at you by being rude to the officer.
Say as little as possible. The statements you make at the scene, in the police car, and at the jail are often videotaped. Statements you make can be brought against you in a Court of Law. Do not help the prosecutors by saying "I couldn't even do this test if I was sober."
Remember the video. The police are videotaping you. Do not sway back and forth, lean against your car, or engage in any other action suggesting you are intoxicated.
